These Terms of Use (“Terms”) govern your access to and use of the Giving Wellness mobile application and website (together, the “Service”), operated by Giving Wellness, LLC (“Giving Wellness,” “we,” “us,” “our”). By creating an account, registering for a program, or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Medical & Health Disclaimer, each of which is incorporated by reference.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. If you are participating through an employer or organization (“Program Sponsor”), your access may also be subject to your Program Sponsor’s own policies and your enrollment status with that Program Sponsor.
Giving Wellness provides a structured wellness challenge (currently an eight-week program) delivered through the Service, including habit and goal tracking, food and activity logging, educational content modules (“The Well”), a community chat feature, a points and leaderboard system, and optional integration with third-party wearable devices and health platforms.
You agree to provide accurate and complete information when creating your account and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use of your account.
If enrollment in a program requires payment, fees will be presented at the time of registration and processed through our third-party payment processor.
When using community features (posts, comments, messages, tagging), you agree not to:
We may remove content or suspend accounts that violate these guidelines, in our discretion.
By posting content to the Service (including community posts, comments, and profile photos), you grant Giving Wellness a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely in connection with operating and improving the Service. You retain ownership of your content.
The Service may allow you to connect third-party services, including wearable devices/health platforms and a third-party nutrition database used to look up food information. Your use of those third-party services is subject to their own terms and privacy policies, and Giving Wellness is not responsible for their accuracy, availability, or practices.
YOUR USE OF THE SERVICE IS SUBJECT TO THE GIVING WELLNESS MEDICAL & HEALTH DISCLAIMER, WHICH IS INCORPORATED INTO THESE TERMS BY REFERENCE. THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
The Service, including its content, features, design, and the Giving Wellness name and logo, is owned by Giving Wellness, LLC or its licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY SPECIFIC HEALTH, FITNESS, OR WEIGHT-LOSS RESULTS FROM USE OF THE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, GIVING WELLNESS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE.
Participation in any exercise, movement, or fitness-related activity referenced or logged through the Service is voluntary and at your own risk.
You agree to indemnify and hold harmless Giving Wellness from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.
We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service and request account deletion at any time.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws principles.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
