1. Introduction
“Giving Wellness” (“we,” “us,” or “our”) provides an eight-week wellness challenge delivered through our mobile/web application (the “App”) and website (together, the “Service”), including in connection with programs offered through your employer or organization (a “Program Sponsor”). This Privacy Policy explains what information we collect, how we use and share it, and the choices available to you.
By creating an account or otherwise using the Service, you agree to the collection and use of information as described in this Privacy Policy.
2. Information We Collect
Information you provide directly:
- Registration information: first name, last name, email address, and password.
- Profile information: profile photo, username, and anything else you add to your profile.
- Health and wellness information you log: food and beverage entries (including barcode-scanned items), water intake, exercise and movement activity, body weight, and your responses to onboarding and goal-setting questions, including your stated “why.”
- Community content: posts, comments, messages, and photos you share in community chat, group chat, or direct messages.
- Payment information, if applicable, processed through our third-party payment processor.
- Communications you send to us for support or feedback.
Information collected automatically:
- Device and usage information, such as device type, operating system, browser type, IP address, and how you interact with the Service.
- Cookies and similar technologies used on our website.
Information from third-party integrations:
If you connect a wearable device or health platform, we receive the health and fitness data you authorize that platform to share with us. When you connect Google Health, we request read-only access to your activity and fitness data (steps, calories burned, and workout sessions) and your health metrics and measurements (body weight). We use this data only to display your activity and weight history within the Service and to calculate your habit points and progress.
Giving Wellness’s use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements. We do not sell this data, do not use it for advertising, and do not allow humans to read it except with your explicit permission, for security purposes, to comply with applicable law, or where the data has been aggregated and anonymized.
3. How We Use Your Information
- To create and manage your account and provide the Service.
- To track your progress, calculate points, and display your journal, habits, and leaderboard standing.
- To personalize the content and program modules shown to you.
- To enable community features, including posts, comments, and tagging other users.
- To communicate with you about the Service, including support requests and program updates.
- To process payment and manage enrollment through your Program Sponsor.
- To maintain, secure, and improve the Service, and to diagnose and fix technical issues.
- To comply with legal obligations.
We do not use your health and wellness information to make automated decisions that produce legal or similarly significant effects on you.
4. How We Share Your Information
- With other users in your Program Sponsor’s group, to the extent you use community features.
- With your Program Sponsor, limited to [participation/completion status and aggregate program metrics]. We do not share your individual food log, weight, or journal entries with your Program Sponsor without your consent.
- With service providers who perform services on our behalf — hosting, data storage, customer support, analytics, our nutrition database provider, wearable-integration platforms, and our payment processor — who are authorized to use your information only to provide services to us.
- For legal reasons, if required by law, subpoena, or other legal process, or to protect the rights, property, or safety of Giving Wellness, our users, or others.
- In connection with a business transaction, such as a merger, acquisition, or sale of assets, subject to standard confidentiality protections.
- With your consent, for any other purpose disclosed to you at the time we collect the information.
We do not sell your personal information.
5. Health Information and HIPAA
Giving Wellness is a general wellness program. Unless otherwise stated in a specific agreement with your Program Sponsor, Giving Wellness does not act as a “covered entity” or “business associate” under HIPAA, and information you log in the App is not part of a medical record maintained by a health care provider.
6. Data Retention
We retain your information for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements.
7. Your Choices and Rights
- Access and correction: you can review and update most profile and logged information within the App.
- Deletion: you may request deletion of your account and associated information by contacting us using the information below. We may retain certain information as required by law or for legitimate business purposes.
- Communications: you may opt out of non-essential communications at any time.
- State privacy rights: depending on where you live, you may have additional rights under state privacy laws, including rights to know, access, delete, or correct your personal information, and to opt out of certain processing.
8. Data Security
We use administrative, technical, and physical safeguards designed to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Children’s Privacy
The Service is intended for users age 18 or older (or the age of majority in their jurisdiction) and is not directed to children. We do not knowingly collect personal information from children.
10. Third-Party Links and Services
The Service may integrate with or link to third-party services, such as wearable/health platforms, our nutrition database provider, and our payment processor. Those third parties’ own privacy policies govern their handling of your information, and Giving Wellness is not responsible for their practices.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy with a new effective date and, where appropriate, through additional notice.
